Terms of Service

EK SMS is a product of Ek Ra Sunya Inc, a company registered in Kathmandu, Nepal. It lets businesses send SMS in Nepal from the web dashboard, the API and paired EK SMS Gateway Android devices. By creating an account or using the service you agree to these terms, including the Acceptable Use Policy below. If you do not agree, do not use EK SMS.

• Give accurate registration details and keep them current. You are responsible for all activity on your account, including messages sent by your team members, API keys and gateway devices.
• Keep your password and API keys secret. Tell us at [email protected] if you think they have been compromised.
• Sending requires an approved KYC verification. The documents you submit must be genuine and belong to you or your business. We may reject, pause or revisit a verification at any time.

• EK SMS is prepaid. Each message is charged from your credit balance when you submit it.
• Credits are non-refundable. The one exception is a message that fails to send: its charge is refunded to your balance automatically, as shown in your ledger. A message that is sent but not delivered by the recipient's network is not refunded.
• Credits have no cash value and cannot be transferred. Any remaining balance is forfeited when your account is closed, whether by you or by us under these terms.

You may send only from sender IDs approved for your account, or from the shared default sender ID. You must not request or use a sender ID that imitates another person, brand, bank or government body, or that you have no right to use.

You must not use EK SMS to send, or help send, messages that are:

• - spam, or bulk marketing to people who have not agreed to receive it;
• - harassing, abusive, threatening, hateful or offensive towards anyone;
• - fraudulent, deceptive or phishing, including fake links, prizes or payment requests;
• - impersonating another person, business, bank or government body;
• - illegal, or promoting illegal goods, services or activity.

You must have a lawful basis to message every recipient, honour opt-out requests, and comply with the rules of the Nepal Telecommunications Authority and all other applicable Nepali law. You must not try to bypass limits, KYC, sender ID rules or security controls.

We review reports and activity on the platform. If we believe you have broken these terms, we may, at our discretion and without prior notice, warn you, block messages, suspend your account or terminate it. We may report unlawful activity to the authorities and cooperate with lawful requests.

EK SMS is provided as is. Delivery depends on mobile networks and devices outside our control, so we do not guarantee that every message is delivered or delivered on time.

To the extent the law allows, we are not liable for indirect or consequential loss, lost profit or lost data, and our total liability for any claim is limited to the amount you paid us in the three months before it arose. You are responsible for the content you send and for any claims that result from it.

We may update these terms from time to time. Material changes will be communicated via email to the address on your account or via a notice in the dashboard. Continued use of the platform after the effective date constitutes acceptance of the updated terms. These terms are governed by the laws of Nepal.
